Building Additions in Shared and Private Homes

The term “building addition” applies to any indoor addition that is done in an existing building. Each addition requires the submission of the plans to the Planning and Building Committee. The plans will be carefully reviewed, and if it is determined that they meet all of the committee’s building regulations, the application will be discussed and decided upon in the local committee. From the time of receiving the committee’s decision, one must adjust (when necessary) the building plans according to the decision, and submit signed copies.

Usually, it is required to provide various authorizations in order to begin the project. Once all the reviews and inspections are done, the permits are filed and the toll is paid—the permit will be granted and it will be possible to begin the renovation.

Building Additions

A building addition involves paying an improvement levy to the local authority for changes in planning (condominium complexes are exempt from this levy).

Building additions are currently done for expansion purposes in private buildings, if conditions permit. This usually entails adding or enlarging rooms.

Another common building addition is on rooftops, provided that the business owner has proof of ownership over the roof, as well as the consent of all the building’s residents. It is important to conduct a preliminary inspection and obtain the necessary information from the local authorities early on, in order to have all of the required information regarding the property. It is very important to see if there are any opposers, and if so—how many.

Building Permit for a Residential Secure Space (“Mamad”)

In the Israeli reality, a residential secure space is needed from time to time in most areas. The demand for apartments with a residential secure space increases in old apartments that are not near public secure spaces. These days, each private or shared building permit application in obligated to include this room. The minimal size is 5 square meters (there is no obligation to include a window), based on the Home Front’s regulations. The standard room has a net size 9 square meters (window is mandatory), and it is subject to all the various regulations. A permit for a residential secure space is granted when there is consent by the neighbors and when there is unexploited construction space. There is also an additional option, subject to the local zoning and to the local plans or regulations.

To sum up, building additions in apartment buildings reflect the ability of each tenant to change his/her property. The consent of 75% of the apartment owners is required for building additions applications to be authorized, inasmuch that the request does not damage the building’s exterior, core, infrastructure, or any other communal field.
